    At the level of the application of §§ 185 ff. StGB in individual cases, Article 5, Paragraph 1, Clause 1 of the Basic Law requires a weighting of the impairment that threatens personal honor on the one hand and freedom of expression on the other, in all essential circumstances must be taken into account (cf. BVerfGE 7, 198 ; established case-law).

    If the controversial statement is a contribution to the formation of public opinion, according to the established case law of the Federal Constitutional Court, a presumption speaks in favor of freedom of speech (cf. BVerfGE 7, 198 ; 61, 1 ).
